Who is required to register?

Oil Spill Prevention, Response & Administration Fee Registration Information
The following entities are required to register with the Board of Equalization:

  • Marine terminals located in state waters
  • Refineries in this state
  • Pipelines that transport crude oil or petroleum products

This registration requirement applies to both the oil spill prevention and administration fee and the oil spill response fee.
The oil spill prevention and administration fee applies to the owner of crude oil at the time that crude oil is received at a marine terminal from within or outside the state, and the owner of petroleum products at the time that those petroleum products are received at a marine terminal from outside this state. The fee is collected by the marine terminal operator from the owner of the crude oil or petroleum products on each barrel of crude oil or petroleum products received by any mode of delivery that passed over, across, under or through waters of the state. In addition, unless the fee has previously been collected or paid, an operator of a refinery is required to collect and pay the oil spill prevention and administration fee for each barrel of crude oil or petroleum products received from within or outside the state by any mode of delivery that passed over, across, under or through waters of the state.

The oil spill response fee applies to the owner of petroleum products at the time that petroleum products are received at a marine terminal by vessel originating from outside the state. The fee is collected by the marine terminal operator from the owner of the petroleum products on each barrel received. The oil spill response fee is also imposed upon a pipeline operator for each barrel of petroleum product transported into this state by means of a pipeline operating across, under, or through waters of the state and for each barrel of crude oil transported out of this state by means of a pipeline. Additionally, the oil spill response fee is imposed upon a marine terminal operator for each barrel of crude oil transported by vessel from within this state to a destination outside this state and upon refinery operators for each barrel of crude oil received by any method of transport.
