recovery on the grounds that the property was erroneously or illegally seized.

The property consists of 8 cartons 80 packs Smokin Joes brand cigarettes, 7 packs Swisher Sweets brand cigarettes, 3 packs Dutch Treats brand cigarettes, 8 packs Santa Fe brand cigarettes, and various brands of tobacco products. This property was seized pursuant to Revenue and Taxation code 30436, Business and Professions Code Section 22974, and Business and Professions Code Section 22974.3 (b) on November 8, 2006, at 12:50 PM from Marwa R. Mallouhi, Etal., dba: Circle S Market located at 1040 W.40th Street, San Bernardino, CA 92407.
