Any person having any right, title, or interest in the following property, may, within twenty (20) days from the date of publication of this notice, file a verified petition stating his or her interest in the property, and requesting the release or recovery on the grounds that the property was erroneously or illegally seized. The verified petition requesting release or recovery of the property must be filed with the Chief, Board Proceedings Division; State Board of Equalization; 450 N Street, MIC:81; PO Box 942879; Sacramento, CA 94279.
The property consists of 99 Swisher Sweets brand cigars untaxed tobacco, 19 “Bonus Boxes” of Swisher Sweets brand cigars untaxed tobacco, 61 Five-packs of Swisher Sweets brand cigars untaxed tobacco, 52 Optimo brand cigars untaxed tobacco, 22 “Bonus Boxes” of Optimo brand cigars untaxed tobacco, 9 Black & Mild brand cigars untaxed tobacco, 4 25 pipe-tobacco cigar box Black & Mild brand cigars untaxed tobacco, and 30 pouches of Bugler brand roll-your-own untaxed tobacco. This property was seized pursuant to Business and Professions Code Section 22974.3 on October 10, 2006, at 4:20 p.m. from Tawfiq Saeed Muthana Amer, dba: Primo Mini Mart located at 4692 E. Shields Ave., Fresno, CA 93726.
