Any person having any right, title, or interest in the following property, may, within twenty (20) days from the date of publication of this notice, file a verified petition stating his or her interest in the property, and requesting the release or recovery on the grounds that the property was erroneously or illegally seized. The verified petition requesting release or recovery of the property must be filed with the Chief, Board Proceedings Division; State Board of Equalization; 450 N Street, MIC:81; PO Box 942879; Sacramento, CA 94279.
The property consists of 505 cartons of Marlboro brand, 20 cartons of More brand, 180 cartons of Kool brand, 450 cartons of Camel brand,150 cartons of Winston brand, 350 cartons of Benson & Hedges brand, 150 cartons of Parliament brand, 150 cartons of Capri brand, 60 cartons of Salem brand, 50 cartons of Virginia Slims brand, and 90 cartons of Pall Mall brand of unstamped cigarettes. This property was seized pursuant to Business and Professions Code Section 22978.2, on August 8, 2006, at 5:30 pm from Enrique Garcia, dba: Enrique Garcia located at USBP Checkpoint I-5 North, San Clemente Station.
