recovery on the grounds that the property was erroneously or illegally seized.

The property consists of Counterfeit Stamped Cigarettes: 50 cartons – 6 packs GT One Brand, 25 cartons – 11 packs Marlboro Brand, 6 cartons – 6 packs GPC Brand, Unstamped Cigarettes: 10 packs Al Capone Brand, Untaxed Tobacco: 101 sticks Havana Honey Cigars, 2 boxes La Vieja Habana Cigars, 20 per box, 68 tubes Royal Blunt Brand, and Non-MSA Compliant: 3 cans VTC brand cigarette tobacco. This property was seized pursuant to Revenue and Taxation Code Section 30436, Business and Professions Code Section 22974.3, on April 12, 2006, at 3:30 p.m. from Mazen Y Abdeljawad, dba: Gifts & Tobacco located at 4414 University Pkwy #2, San Bernardino, CA 92407.
