YEE: Item C2 from yesterday. This is the 5 City of Pomona and town of Los Gatos, tax reallocation 6 hearing. 7 Mr. Levine, do you have an update for us? 8 MR. LEVINE: Yes. Good morning, Madam Chair, 9 Members. David Levine for the Appeals Division. 10 The parties met yesterday. They're hopeful of 11 reaching a settlement, though not certain. They have 12 their governmental problems which -- with reaching a 13 final settlement. And, understandably, they don't want 14 to submit their suggested line drawing, if they can't 15 reach a settlement where you should draw the line unless 16 their settlement negotiations break down. 17 So, if they don't reach a settlement we'll need 18 some more time to allow the settlement discussions to go 19 on and have them submit their suggested line drawing and 20 then for the Department to respond and us. 21 I think that if settlement broke down we could 22 bring it back for decision in December. So if you will 23 allow it to be delayed until December for that, that 24 would be helpful. 25 And then if they notify us that they've reached 26 a settlement, that will be much easier for us to bring 27 forward in which case we would try and get it on an 28 earlier calendar. 3 1 MS. YEE: All right. Okay. 2 MR. LEVINE: And I did just get a report this 3 morning from one of the parties that they're really 4 hopeful of settling. I am, too. I bet you are, too. 5 But I'll believe it when I get the confirmation. 6 MS. YEE: Okay. Thank you, Mr. Levine. 7 Any discussion or comments on that particular 8 matter? 9 MR. LEONARD: December of what year? 10 MR. LEVINE: I hope this -- this year is what 11 I'm asking for. 12 MS. YEE: Okay. Thank you very much for the 13 update.
