            5            MS. OLSON:  The next item is F2, Sales and Use 

            6   Tax Regulation 1591, Medicines and Medical Devices.  

            7   It's a public hearing

            8            MS. YEE:  Okay.  

            9            Okay, Mr. Tucker.  

           10            MR. TUCKER:  Good morning Madam Chairwoman and 

           11   Members.  My name is Robert Tucker on behalf of the 

           12   Legal Department. 

           13            Staff is requesting that the Board adopt the 

           14   proposed amendments to Regulation 1591.  These 

           15   amendments will clarify that all permanently implanted 

           16   articles include the implant's interdependent internal 

           17   and external components which operate together as one 

           18   device in and on the person in whom the device is 

           19   implanted.  Including ear implants unless the device is 

           20   excluded from the definition of medicines.  

           21            Thank you.  

           22            MS. YEE:  Thank you.  We have no speakers  

           23   signed up for this item.  

           24            MR. LEONARD:  Move adoption.  

           25            DR. CHU:  Second.  

           26            MS. YEE:  Second by -- excuse me, motion by Mr. 

           27   Leonard, second by Dr. Chu to adopt the staff 

           28   recommendation.
