25174.8. Federal Receipts Account. (a) All fees assessed pursuant to this chapter, and received from agencies of the federal government, shall be deposited in the Federal Receipts Account which is hereby created as a subaccount in the Hazardous Waste Control Account. Upon appropriation by the Legislature, money in the Federal Receipts Account may be expended by the department for the purposes of this chapter, but may not be expended for site remediation or the removal of hazardous substances. Notwithstanding this section, fees or other money provided to the department by federal agencies to reimburse the state for its costs of overseeing or undertaking remediation or removal on specific federally owned sites, including, but not limited to, investigation and characterization, shall not be placed in the Federal Receipts Account. In addition, any money received through grant or agreement to be placed in the Federal Trust Fund, in accordance with Article 1.5 (commencing with Section 16360) of Chapter 2 of Part 2 of Division 4 of Title 2 of the Government Code, shall not be deposited in the Federal Receipts Account.

(b) This section shall become inoperative on June 30, 1999, and, as of January 1, 2000, is repealed, unless a later enacted statute, that becomes operative on or before January 1, 2000, deletes or extends the dates on which it becomes inoperative and is repealed.
