(a) IN GENERAL

170.0007.140 Effect of Bankruptcy Court Decision on Petition. A Notice of Determination was issued to the taxpayer, and the taxpayer filed a timely petition for redetermination. The taxpayer then filed Chapter 11 bankruptcy and the Board filed a proof of claim for $125,286 in the taxpayer's bankruptcy action. The taxpayer objected to the Board's claim. After hearing the taxpayer's objection, the bankruptcy court held that the taxpayer's liability should be reduced to $50,997. The taxpayer's plan of reorganization incorporating the bankruptcy court's decision on the taxpayer's dispute has established the amount of the obligation owed by the taxpayer to the Board. The Board should take no further action on the taxpayer's petition. 8/4/97. (M98–3).
